TERMS AND CONDITIONS

Terms of Agreement with CIBA VISION Corporation ("CIBA"). Submission of my testimonial, opinion, photo and/or other submission is subject to the following terms and conditions.

1. I have been informed and understand that CIBA is collecting, and possibly posting testimonials and photos of patients wearing AIR OPTIX contact lenses. I am submitting my testimonial, opinion, photo and/or other submission on CIBA's website, airoptix.com, with the understanding that it/they may be posted on CIBA's website.

2. I grant CIBA and its designees the right to use in whole or in part my name, photo, occupational data, city of residence, opinions as embodied in such testimonial, whether transferred to airoptix.com or other CIBA websites, CD-ROM, DVD, or other media, now known or later developed. I hereby assign to CIBA any and all ownership interests I have in the materials I submit to CIBA's website and grant CIBA the right to use or re-use the testimonial, opinion, photo and/or other submission as CIBA may elect.

3. CIBA or its designee shall have complete ownership of the testimonial, opinion, photo and/or other submission which I provide, including copyright interests in the same. I also grant CIBA and its designees the right to broadcast, exhibit, market, and otherwise distribute the testimonial, opinion, photo and/or other submission, either in whole or in parts, for commercial or non-commercial use. This grant includes the right of CIBA to use the testimonial, opinion, photo and/or other submission for training purposes or for the promotion or advertising of CIBA's AIR OPTIX brand contact lenses. I understand that CIBA may share my information and submissions with its affiliated companies and business partners, such as companies it works with to prepare advertising and training materials. The rights granted CIBA herein are perpetual and worldwide.

4. I confirm that I have the right to enter into this Agreement, and that CIBA has no financial commitment or obligations to me as a result of this Agreement. I hereby confirm that I have not been paid to submit the testimonial, opinion, photo and/or other submission I make to the CIBA website. Moreover, I understand that CIBA is under no obligation to publish or use the testimonial, opinion, photo and/or other submission I make to the CIBA website. I further acknowledge that I am not entitled to, nor do I expect additional consideration for the rights granted to CIBA pursuant to this Agreement.

5. I warrant that I am 18 years of age or older, and that I have every right to contract in my own name. I warrant that any testimonial I provide will be a true and accurate representation of my experience with AIR OPTIX brand contact lenses from CIBA VISION.

6. I have read and understood each and every word of the foregoing prior to acceptance. I evidence my agreement with the foregoing Terms of Agreement by clicking on the I AGREE button below.
